  • At the start of a lease it is essential to appoint one of our specially trained Surveyors to identify existing faults. Modern leases require the tenant to put and keep the premises in repair. This onerous obligation can be mitigated by stating it is to be kept in no better state than exists at the beginning of the lease. A Schedule of Condition is required to set the benchmark against which this is measured and helps minimise any dilapidation claim at the end of the lease.

    Improvements and alterations may require Building Regulations Approval and, if the premises are leased, Landlord’s approval. Detailed plans are required and we can produce these together with advice as to how the work can be carried out and how to get the most out of your premises. Ongoing supervision of these works is essential and we can provide this service.

    As Health and Safety Regulations become more and more onerous, occupiers need to comply with these requirements. We can provide the necessary assessments and certificates.

    At lease expiry, if the premises are not delivered up in the condition required by the lease, i.e. in repair, the Landlord will seek to ensure that the works are either carried out or they are paid compensation. We have extensive experience in negotiating these claims to ensure that they are fair and comply both with Statute and the terms of the lease and therefore, ensuring any dilapidation claim is kept to a minimum.
